Using this site
This site is for adults: you must be at least 18 to submit our forms. The site and everything on it is provided for general information about the Tulsa-area real estate market and our services. It is not legal, financial, tax, lending, or investment advice, and nothing on it is a promise about what any specific property will sell for.
Home-value estimates are opinions, not appraisals
This is the most important section on this page. When we prepare a home-value analysis, equity report, market report, or any similar estimate - whether delivered on this site, by email, or by text - it is a broker's informed opinion of probable value, based on market data, comparable sales, and our local experience. It is not an appraisal, it is not prepared by a licensed or certified appraiser, and it should not be used as one. Lenders, courts, and government agencies require a licensed appraisal; our analysis is not a substitute for that. Real estate values change with the market, data sources contain errors, and the only price that ultimately matters is the one a real buyer agrees to pay. We stand behind the care we put into every analysis, but you agree not to treat any estimate from us as a guarantee of value or a promise of a sale price.
Browsing this site doesn't make us your agent
An agency relationship - where we legally represent you in a transaction - is created only by a written agreement signed by both of us, as Oklahoma law provides. Visiting this site, requesting a home-value analysis, joining a list, or exchanging messages with us creates no agency relationship, no obligation, and no cost. That's a feature, not a trick: you can use everything here freely before deciding whether to work with us.
How we communicate
If you submit a form with your phone number, the consent statement above that form's button is part of these terms: you agree we may call and text you (SMS/MMS) at that number about the things listed there, including with automated technology, and that consent is never a condition of getting our services. Our content, your license
The content on this site - text, market analyses, photographs, graphics, reports, page designs, and data compilations - belongs to us or our licensors, and all rights are reserved. You're welcome to view it, save it, and share links to it for your own personal, non-commercial use. You may not republish it, sell it, or pass it off as your own, and you may not scrape, harvest, data-mine, or bulk-download the site or its data - by hand or with software - or use the site to build a competing product or dataset, interfere with its operation, or probe it for vulnerabilities. Listing and market data on this site comes from sources we believe reliable but is not guaranteed; verify anything material independently before relying on it.
Copyright complaints
We respect other people's intellectual property. If you believe something on this site infringes your copyright, email info@vostratulsa.com with: (1) what work you own, (2) the URL where you believe it's infringed here, (3) your contact information, and (4) a signed statement, under penalty of perjury, that you have a good-faith belief the use is unauthorized and that you are the owner or the owner's authorized agent. If a complaint checks out, we'll promptly remove or fix the material. Knowingly false claims can make you liable for damages and fees.
No warranties
We work to keep this site accurate, current, and available, but we provide it "as is" and "as available," without warranties of any kind, express or implied - including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, and any warranty that the site will be uninterrupted or error-free. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
Limit on our liability
To the maximum extent Oklahoma law allows, we (including Pingleton Real Estate Inc, Brian Pingleton, and our team members) are not liable for indirect, incidental, consequential, special, or punitive damages arising out of your use of this site or its content - and our total liability for any claim connected to this site is capped at one hundred dollars ($100), since the site is free to use. This cap doesn't apply to anything that can't legally be limited, and nothing in these terms limits the professional duties we owe a client under a signed representation agreement or Oklahoma license law - those are governed by that agreement and that law, not this page.
Your responsibility
You agree that the information you submit through our forms is accurate and yours to give - in particular, that a phone number you provide is your own. If a third party brings a claim against us because you broke these terms, violated the law, or submitted someone else's information as your own, you agree to cover the costs and damages that claim causes us.
If we ever have a dispute
These terms and any dispute connected to this site are governed by Oklahoma law. Here is how we've agreed to resolve disputes, and we think it's fair to both sides:
Talk first. Before anything formal, either of us must email or mail the other a plain description of the problem and give the other side 30 days to fix it. Most problems die here, where they should.
Then individual arbitration. If 30 days pass without resolution, any remaining dispute will be resolved by binding arbitration before a single arbitrator under the American Arbitration Association's Consumer Arbitration Rules, held in Tulsa County, Oklahoma (or by phone or video if you prefer), rather than in court. The Federal Arbitration Act governs this section. Either of us may instead bring an individual claim in small-claims court if it qualifies there.
Individually, not as a class. Disputes will be arbitrated only on an individual basis. Neither of us may participate in a class action, class arbitration, or representative proceeding against the other, and the arbitrator may not consolidate claims or award relief to anyone but the individual parties. By agreeing to arbitration, both of us also give up the right to a jury trial for covered disputes.
Your right to opt out. Arbitration should be a choice, so here is a real one: within 30 days of first accepting these terms, you may opt out of this arbitration section entirely by emailing info@vostratulsa.com with your name, phone number, and the statement "I opt out of arbitration." Opting out affects nothing else - your access to the site and our services is exactly the same either way. If any part of this section is found unenforceable, the rest of these terms still stand, and any class-action waiver question is for a court, not the arbitrator, to decide.
Fair housing
We fully support the principles of the Fair Housing Act and the Equal Opportunity Act. Every service we offer, on this site and off it, is offered without regard to race, color, religion, sex, disability, familial status, or national origin.
Changes and housekeeping
If we change these terms in a way that matters, we'll change the effective date at the top of this page, and material changes apply going forward from that date - the terms you accepted when you submitted a form are the terms in effect that day. If any provision of these terms is found invalid, the rest remain in force. These terms, together with our Privacy & Tracking Policy, are the entire agreement between you and us about the use of this site; a signed representation agreement, if we make one, governs the actual work of buying or selling. We may assign these terms as part of a sale or reorganization of our business; they otherwise aren't assignable.
